Aadhaar is mandatory and not mandatory

  • However, the top court upheld section 139AA of Income Tax Act, which says quoting of Aadhaar mandatory for making an application for allotment of Permanent Account Number (PAN) and income tax return filing.
  • At the same time, the top court struck down the Section 57 of Aadhaar Act, as a result, private companies cannot ask for Aadhaar for providing services like telephone connection.

Here is a list of services for which Aadhaar is mandatory now

-Applying for PAN
-Income tax return filing
-Getting direct benefit transfer for government-run welfare schemes like LPG subsidy, Public Distribution System (PDS) and employment guarantee scheme

-Mobile connections
-Demat account opening
-Mutual fund investment
-School admission
-CBSE, NEET, UGC cannot make Aadhaar mandatory
-No child can be denied benefits of any schemes on not being able to bring Aadhaar

  • The apex court struck down the provision in Aadhaar law which allowed sharing of data on the ground of national security.
  • It also said that there is a fundamental difference between Aadhaar and other identity proof as Aadhaar cannot be duplicated and it is a unique identification number.
  • It added that Aadhaar is to empower the marginalised sections of the society, and it gives them an identity.
